OFFICINE MALAGUTI SRL,

located in Sant'Agata Bolognese (BO), Via XXI Aprile, 1945, No. 60 - VAT No. 03520240379 - (hereinafter, "Controller"), as the data controller, pursuant to art.13 of EU Regulation No. 2016/679 (hereinafter, "GDPR") and the changes introduced by Legislative Decree 30.6.2003, No. 196 as updated by Legislative Decree 101/2018 (hereinafter, "Privacy Code"), would like to inform you of the following.

By visiting the websites, both web and mobile, of Officine MALAGUTI S.r.l. (hereinafter, "Malaguti") with your browser set to accept cookies and continuing navigation (i.e., closing the pop-up with the "brief" information by selecting the "I ACCEPT" button, clicking any element of the page outside the pop-up, or selecting the "SAVE AND EXIT" option from the second pop-up after consenting to cookies), you consent to the use of cookies as described in this Cookie Policy and in the specific privacy notices of the sites owned by Malaguti, listed later in this Cookie Policy.

This Cookie Policy, provided by Malaguti as the Controller, aims to illustrate the types and purposes of cookies used by Malaguti's sites and to explain how to manage your preferences regarding the use of cookies.

  1. Consent and refusal management methods for cookies Through the pop-up and this Cookie Policy, you can express your preferences regarding various types of cookies and modify them later. These preferences will be recorded in a specific cookie consent management platform (the so-called "CMP," or "Consent Management Platform"), developed in compliance with privacy regulations and according to the principles and guidelines provided by the Interactive Advertising Bureau (IAB).

The CMP allows you to give or deny consent simultaneously for various types of cookies, whether issued directly by Malaguti or by its partners and suppliers. This means that it is not necessary to express a preference for each individual cookie or provider, although this is still allowed directly by the CMP. Different types of cookies are identified and classified based on the purposes for which the cookies are issued and used, making their recognition easier, even for non-specialists.

In the event that you have given consent to all cookies and, therefore, do not see the pop-up every time you open the site of your interest, you will find the list of all Malaguti's sites ("domains") with a link to the CMP of each one later in this cookie policy.

It is important to note that some browsers capture the preferences you express regarding consents on a single Malaguti domain site and automatically propagate them to all other Malaguti domains.

  1. What are cookies Malaguti's sites use cookies or markers, which are technically packets of information sent from a web server to the visitor/user's Internet browser and automatically stored on the device (personal computer, tablet, mobile, etc.) and sent back to the server upon each subsequent access to the site. The cookie can only be used by the web server that issued it (or by any third parties with whom it was originally shared). This means, for example, that cookies generated by Malaguti cannot be read by servers managed by third parties.

Some cookies are necessary for the proper provision of the site or useful for its personalized use. In this case, their inhibition could compromise some site features.

Malaguti may also publish on its sites, directly or through third parties, advertising corresponding to your interests, deduced based on your online activities and browsing habits. Please note that if you decide to disable cookies aimed at providing "targeted" or "behavioral" advertising, generic advertising banners will continue to be displayed.

By default, almost all web browsers are not set to automatically accept cookies. Visitors/users can, however, change the default configuration, as further explained in this Policy.

For further information regarding the data controller of your personal data, the processing methods, categories of controllers and processors, the exercise of rights under articles 15-22 of EU Regulation 679/2016 ("GDPR"), or additional processing related to the data provided during registration for Malaguti services, please refer to the Privacy Policy of each individual site or the specific privacy notices for services provided by Malaguti through its sites. You can also send an email through the contact form on the contact page.

A) Types of Cookies Persistent Cookies: These cookies remain stored until their expiration on the user/visitor's device. They are used to facilitate navigation within the site, ensure its correct use, facilitate access to services that require authentication (avoiding users having to re-enter authentication credentials each time they access services), for statistical purposes, to know which areas of the site have been visited, and, in some cases, for optimal management of pages and advertising spaces, or to provide content and advertising in line with choices made by users.

Session Cookies: These cookies are not stored persistently on the user/visitor's device and disappear when the browser is closed. They are used to transmit session identifiers necessary to allow safe and efficient exploration of the site. Session cookies used on Malaguti's sites avoid the use of other potentially privacy-invasive computer techniques and are also used to improve service delivery.

First-Party Cookies: These can be both persistent and session cookies, managed directly by the owner and/or manager of the site. They are used, for example, to guarantee its technical operation (the so-called "technical cookies") or to keep track of preferences expressed regarding the use of the site itself (for example, to display weather forecasts for your city).

Third-Party Cookies: These can also be both persistent and session cookies, generated and managed by parties other than the site visited by the user and are used, for example, to know the number of pages visited within the site (the so-called "statistical cookies" or "analytics cookies") or to publish content or advertisements on the site being visited.

B) Main purposes of cookies Technical Cookies: These are cookies necessary to allow site navigation and the use of certain products and services. They are used, for example, to recognize the user who has logged into their email account and keep the session open even when visiting other pages of the site, or to ensure certain security measures for the site and monitor its correct operation.

Statistical or "Analytics" Cookies: These cookies are used to monitor the performance of the site, for example, to know the number of pages visited or the number of users who have viewed a particular section. In general, the analysis of these cookies generates anonymous and aggregated statistical data without any reference to the identity of site visitors. They are also useful for evaluating any changes and improvements to the site itself.

Cookies for storing preferences: These cookies are useful for facilitating the correct use of the site by the user and creating a browsing experience that adheres to expressed expectations. They are used, for example, to keep track of the chosen language.

Advertising Cookies: These cookies are intended for the delivery of advertising spaces. These cookies are installed, either directly by Malaguti or by third parties (for example, partners and suppliers). Some of them are used to calculate the value of the advertising offer, identify individual advertising messages, and know which ones have been selected and when. Other advertising cookies, such as Behavioral Cookies and Retargeting Cookies, are used to deduce your "profile" as a navigator and subsequently propose advertising messages in line with your online behavior (both on and off Malaguti sites) and presumably in line with your interests. This "profile" is anonymous, and the information collected through these cookies does not allow identification.

Social Network Cookies: These are cookies that allow you to share the contents of the site you are visiting with other users or express your opinion about it. These are typically cookies used to activate "Like" or "Follow" functions on Social Networks such as Facebook and Twitter, to name a few. These functions allow Social Networks to identify their users and collect information even while browsing other sites. MALAGUTI recommends consulting the privacy policy of each Social Network you use to learn about the purposes and methods of data processing carried out by them.

  1. First and Third-Party Analytical and Profiling Cookies Thanks to the CMP, you can directly manage both first-party and third-party cookies based on their purposes, as specified at the beginning of this Cookie Policy.

Please note that some browsers capture the preferences you express for only one of the following Malaguti sites and automatically apply them to all other sites listed here; others only store the preferences of the site you visited.

  1. Clarifications on third-party cookies Malaguti's sites may use anonymous third-party cookies for the purpose of dynamically and evolvingly displaying advertisements, or advertisements based on browsing choices made by users, even on sites unrelated to Malaguti. In many cases, Malaguti does not have access to or control over the information that third parties may collect through their cookies.

On Malaguti's sites, after a search, so-called "sponsored links" are also displayed: these are search results purchased by third-party companies that want to promote themselves through websites in reference to specific search terms strictly related to their activities.

Malaguti's sites use third-party cookies also for purely statistical purposes, such as knowing the number of pages viewed and the number of unique users, or understanding how users interact with content (including advertisements) on sites and mobile applications.

In addition, Malaguti's sites include the use of cookies from the most popular Social Networks such as: Facebook Instagram Youtube Linkedin

You can consult the Privacy Policy and express your preferences regarding third-party cookies with which Malaguti has entered into agreements for the provision of advertising based on information collected through cookies by directly connecting to the CMP.

However, some cookies are also installed on the owner's or manager's site independently of direct agreements with partners and suppliers adhering to the CMP platform adopted by Malaguti. To find out which third-party cookies are present on your device, you can also refer to the website www.youronlinechoices.com. Many companies that generate cookies on third-party sites offer the possibility of easily and immediately deactivating and/or inhibiting only their own cookies, even when these are anonymous, i.e., do not involve the recording of identifiable personal data, in accordance with the provisions of the Network Advertising Initiative.

  1. Cookie management through the browser It is possible to remove existing cookies and block the installation of new cookies through browser settings.

If users/visitors want to decide each time whether to accept cookies, they can also configure their browser to generate an alert every time a cookie is saved.

The most common browsers allow you to block only third-party cookies, accepting only those of the site itself.
